1. Acceptance of Terms
By accessing ClarityCommerce, you agree to these Terms. If you are using the platform on behalf of a business, you represent that you have the authority to bind that entity to these terms.
2. The Governance Gate & Human Liability
ClarityCommerce features autonomous AI agents capable of executing commerce operations (e.g., updating pricing, launching campaigns). However, all high-risk or financial actions are routed through the Governance Gate, requiring explicit human approval.
You retain ultimate responsibility and liability for any action executed by the Digital Workforce that you have approved via the platform. ClarityCommerce is a strategic tool, not a legal or financial fiduciary.
3. AI Limitations & "As-Is" Insights
The Executive AI and Dual-Engine (Opportunity/Risk) analyses are generated using probabilistic machine learning models. While we strive for accuracy, AI can produce hallucinations or outdated market assumptions. You must independently verify all strategic recommendations before approval.
4. Acceptable Use Policy
You agree not to use ClarityCommerce to:
- Execute fraudulent commerce activities, fake reviews, or market manipulation.
- Scrape competitor data in violation of third-party Terms of Service.
- Upload malicious payloads designed to exploit the MCP (Model Context Protocol) tool architecture.
5. Subscriptions & API Limits
Access to the platform is governed by your selected subscription tier. We reserve the right to rate-limit or throttle AI mission executions if you exceed the fair-use compute thresholds of your tier to ensure platform stability for all tenants.
6. Limitation of Liability
To the maximum extent permitted by law, ClarityCommerce shall not be liable for any indirect, incidental, or consequential damages, including lost profits or revenue resulting from AI-generated strategies, platform downtime, or third-party API failures (e.g., Shopify/WooCommerce outages).
